Terms of Use

These unified terms apply to Throwback on iPhone and the web, with clear platform-specific rules for accounts, generation and billing.

Two platforms. Two separate memberships. An iOS subscription purchased through Apple does not unlock Throwback Web. A web subscription purchased through Stripe does not unlock premium access in the iOS app. Each must be purchased, managed and cancelled through its own platform.

1. Agreement and eligibility

These Terms of Use ("Terms") govern the Throwback iOS application, Throwback Web at throwback.now, and related services operated under the Throwback brand (together, the "Services"). The Services are operated by App Star Family ("we," "us," or "our").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 13 years old. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use.

2. The Throwback service

Throwback is a creative photo product for applying camera-era treatments, assembling Rolls and Retro Cards, rediscovering selected photos by year, and creating AI Time Portraits. Features differ by platform and may include free and paid functionality.

Throwback Web. Photo Lab, Rolls, Retro Cards and Year Vault are designed to operate locally in the browser where applicable. AI Time Portrait is a distinct server-authorized feature that sends the photo you select for cloud processing after notice and confirmation. Local tools do not use an AI generation allowance.

Throwback iOS. The native app provides its own local editing, camera, Photos, gallery and AI Time Portrait experiences. It uses Apple platform services and separate App Store subscription entitlements.

Promotional and example images show creative direction, not a promise that every source photo will produce the same result. Only the features, prices and limits shown in the current product and purchase flow form part of the offer available to you.

3. Throwback Web accounts

An eligible first AI Time Portrait can be created in a private browser session without entering an email address. Supabase recognizes that session securely; it does not require a visible account signup. Verify an email to recover your portraits and membership on other devices. Ending an unverified session or clearing browser data may prevent recovery. You are responsible for using an email address you control, protecting one-time codes and authenticated browser sessions, and notifying us if you believe an account has been accessed without permission. Do not share sign-in codes or attempt to use another person's account.

You must provide accurate information and may not create additional accounts to repeat a limited offer, evade a generation allowance or bypass service controls. The current iOS app does not use the Throwback Web account as an iOS entitlement and does not require that web account for its native account-free features.

To request deletion of a web account, email info@appstarfamily.net from the address used for the account. The current browser account panel does not include automated account deletion.

4. AI generation offers, allowances and fair use

One successful free web generation

Each eligible Throwback Web visitor or existing account may receive one successful AI Time Portrait generation without a web subscription. A free generation is used only when a valid result is successfully completed and recorded for the private session or account. Signing in, subscribing, starting a trial or connecting a journey does not reset a consumed free generation. A failed generation or a cancellation completed before success does not use it. If generation has already completed successfully when cancellation is requested, the result may count as the successful free generation.

This is a limited introductory offer, not a right to obtain multiple free results by replacing browser sessions or creating accounts. We may refuse or withdraw the offer where reasonably necessary to prevent abuse, fraud or circumvention.

Paid web generation

After the successful free web generation is used, additional web AI generation requires an active Throwback Web subscription and is subject to the generation allowance and usage window displayed in the product. A paid subscription is an allowance, not unlimited provider use. Technical rate limits, one-generation-at-a-time controls, safety rules and reasonable anti-abuse measures may also apply. Failed or cancelled generations are handled according to the account status shown by the product.

We may adjust future generation limits to reflect provider cost, capacity, safety or product changes. Material changes will be shown in the product or purchase flow and will not turn an iOS subscription into a web entitlement or vice versa.

iOS generation access

Any free preview, generation allowance or premium access offered in the iOS app is governed by the eligibility and entitlement state shown in that app. It is separate from the one-successful-generation web offer and from Stripe web usage accounting.

5. Subscriptions, renewals, cancellations and refunds

Separate platform entitlements

  • iOS subscription: purchased for the native iOS app through Apple's App Store and managed through Apple's purchase system with RevenueCat supporting product and entitlement status. It does not grant a Throwback Web subscription.
  • Web subscription: purchased for throwback.now through Stripe and managed through the web account's Stripe billing portal. It does not grant an App Store or iOS subscription.

Buying on one platform does not unlock the other. Restore Purchases in the iOS app restores only eligible App Store entitlements; it does not look for a Stripe purchase. The web account checks only the separately authorized Stripe subscription state and does not look for an App Store purchase.

iOS App Store billing

The App Store displays the available product, localized price, billing period and any eligible introductory offer before purchase. Payment, renewal, cancellation and refund eligibility are governed by your Apple account, Apple's terms and the disclosures shown by the App Store. Manage or cancel the subscription in your Apple account's Subscriptions settings. Refund requests for App Store purchases must be made through Apple.

Stripe web billing

The web checkout displays the selected price and recurring billing interval before purchase. The yearly Throwback Web plan includes a three-day free trial and then renews at the annual price shown in checkout unless cancelled before the trial ends. The monthly web plan has no trial. A trial is separate from the account's one successful free AI generation and does not reset or replace that offer.

Unless cancelled, a recurring web subscription renews according to the terms shown at checkout. You can manage or cancel it through the Stripe billing portal available from your Throwback Web account. Cancellation timing and access through the end of a trial or billing period are shown by the portal and verified subscription state.

Except where applicable law requires otherwise, completed charges are not automatically refundable. For a web billing question or refund request, contact info@appstarfamily.net. Nothing in these Terms limits mandatory consumer rights.

Price changes

Prices may change prospectively. Apple controls notice and consent for App Store price changes under its rules. Web price changes will be disclosed as required before they apply to a future renewal.

6. Your photos, content and AI results

Your content

You retain your rights in photos, captions and other content you provide ("User Content"). You represent that you have the rights and permissions needed to use the User Content and to authorize the processing described here, including appropriate permission for the likeness of another person shown in a photo.

You grant us a limited, non-exclusive, worldwide license to host, reproduce, transmit, reformat, process and store User Content only as reasonably necessary to operate the feature you request, provide and secure the Services, and comply with law. This license includes allowing the service providers identified in our Privacy Policy to do that work for us. It does not give us permission to sell your photos or use them in advertising.

AI-generated and edited results

As between you and Throwback, and to the extent permitted by law, we do not claim ownership of the creative result generated from your User Content for you. Laws concerning AI-generated material and copyright vary, and we do not promise that a result is protectable by copyright, unique, or free from similarity to other material.

AI results can be inaccurate, unexpected or unsuitable. They may change facial details, clothing, objects, age cues or historical context. Review a result before saving, sharing or relying on it. Do not represent an AI-generated or edited image as an unaltered historical photograph or use it to deceive, defame or violate another person's rights.

7. Acceptable use

You may not use the Services to:

  • break the law or facilitate unlawful activity;
  • create or distribute sexual or exploitative content involving a minor;
  • process a person's likeness without the rights or permissions required in the circumstances;
  • harass, threaten, defame, impersonate, exploit or violate the privacy, dignity or intellectual-property rights of another person;
  • create deceptive deepfakes, fraudulent evidence or manipulated content intended to mislead people about a material fact;
  • upload malware or content designed to disrupt, damage or gain unauthorized access to systems or data;
  • scrape, automate or access the Services at scale without our written permission;
  • reverse engineer or attempt to extract source code, prompts, models, security controls or non-public service components except where law expressly permits it; or
  • evade generation, account, payment, safety or access controls, including by creating accounts to repeat the free web offer.

Provider safety systems may reject a request. A subscription does not guarantee that every request will be processed or that rejected content will receive a result.

8. Throwback intellectual property

The Services, software, interface, branding, Era Pack definitions, photographic process designs, text, graphics and other materials we provide are owned by or licensed to App Star Family and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Services as provided. They do not transfer ownership of the Services or our materials.

If you send feedback or suggestions, you permit us to use them without restriction or compensation, but this does not grant us rights in the personal photos you submit for a Throwback feature.

9. Third-party services

Throwback relies on third-party services including OpenAI, Supabase, Stripe, Apple, RevenueCat and Vercel. Their availability, processing and separate terms may affect features. Your use of Apple's App Store, Stripe checkout or another provider's service is also subject to that provider's applicable terms and privacy notices. We are not responsible for third-party services outside our control, but this does not limit obligations we cannot exclude by law.

10. Availability, changes and termination

We may add, change, limit, suspend or discontinue features for product, provider, capacity, security, legal or business reasons. AI generation can fail, take time or be unavailable, and browser or device support, file size, network conditions and provider capacity may affect a result. You are responsible for downloading or saving content you want to keep; Throwback is not a permanent photo backup.

You may stop using the Services at any time. Stopping use or deleting an app does not itself cancel a subscription. You must cancel through Apple or Stripe as described in Section 5.

We may restrict or terminate access where you materially violate these Terms, create risk or harm, fail to pay applicable charges, or where required by law. Where reasonable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination will continue to apply.

11. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, A PARTICULAR AI RESULT OR PERMANENT STORAGE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APP STAR FAMILY AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, CONTENT OR GOODWILL, ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the provisions above apply only to the extent permitted. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

To the extent permitted by law, you are responsible for losses or claims caused by your unlawful User Content, your violation of another person's rights, or your material violation of these Terms.

12. Governing law and disputes

These Terms are governed by and construed in accordance with applicable law. Mandatory consumer protections available where you live continue to apply. Before starting formal proceedings, you and App Star Family agree to try in good faith to resolve a dispute by contacting the other party and describing the issue and requested resolution.

Send a dispute notice to info@appstarfamily.net. This informal process does not prevent either party from seeking urgent relief or using a process that applicable law requires or preserves.

13. Changes and contact

We may update these Terms when the Services, providers or legal requirements change. We will update the effective date and provide additional notice where required. Changes apply prospectively. Continuing to use the Services after updated Terms take effect means you accept them to the extent permitted by law.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the agreement between you and us about the Services unless separate terms are expressly presented for a feature or purchase.
